1、(本小題可以選用中文或英文解答,如使用英文解答,須全部使用英文,答題正確的,增加5分。)承租人與出租人簽訂一項(xiàng)房屋租賃合同,合同的租賃期限為30年。在合同期限內(nèi),發(fā)生下列事項(xiàng):(1)為了美觀舒適,承租人未經(jīng)出租人同意,自己對(duì)房屋進(jìn)行了裝修,要求出租人承擔(dān)50%的維修費(fèi)用。(2)承租人經(jīng)出租人同意將房屋轉(zhuǎn)租。(3)租賃期間房屋需要維修,承租人也要求維修,但由于沒有維修,致使房屋側(cè)墻倒塌,造成承租人財(cái)產(chǎn)損失。(4)在承租期間,出租人未經(jīng)承租人同意將房屋出售。
要求:根據(jù)以上事實(shí)并結(jié)合法律規(guī)定,回答下列問題:
<1> 、房屋租賃合同是否有效?為什么?

房屋租賃合同部分有效。(1分)根據(jù)規(guī)定,租賃合同的租賃期限不得超過20年。超過20年的,超過部分無效。(3分)
The lease part of the contract is still valid. According to law, the lease term may not exceed twenty years. If the lease term exceeds twenty years, the portion of the lease term beyond the initial twenty year period is invalid. (1分)
<2> 、承租人要求出租人承擔(dān)50%的維修費(fèi)用是否合理?為什么?
【正確答案】
不合理。(1分)根據(jù)規(guī)定,承租人經(jīng)出租人同意,可以對(duì)租賃物進(jìn)行改善或者增設(shè)他物。承租人未經(jīng)出租人同意,對(duì)租賃物進(jìn)行改善或者增設(shè)他物的,出租人可以要求承租人恢復(fù)原狀或者賠償損失。該承租人沒有得到出租人的同意自己進(jìn)行裝修,違反法律的規(guī)定,因此要求出租人支付一半的費(fèi)用是不合理的。(4分)
It is illegal for lessee to demand lessor to afford 50 percent of fix and repair expense. According to law, subject to consent of the lessor, the lessee may make improvement on or addition to the lease item. If the lessee makes improvement on or addition to the lease item without consent of the lessor, the lessor may require the lessee to restore the lease item to its original condition or claim compensation for the losses. In this case, the lessee didn’t get the consent of the lessor, so it is illegal for lessee to demand lessor to afford 50 percent of fix and repair expense.(1分)
<3> 、承租人經(jīng)出租人同意將房屋轉(zhuǎn)租,承租人和出租人之間的關(guān)系是否解除?為什么?

沒有解除。(1分)根據(jù)規(guī)定,承租人經(jīng)出租人同意,可以將租賃物轉(zhuǎn)租給第三人。承租人轉(zhuǎn)租的,承租人和出租人之間的租賃合同繼續(xù)有效。(3分)

<4> 、房屋側(cè)墻倒塌,造成承租人財(cái)產(chǎn)損失,責(zé)任應(yīng)當(dāng)由誰承擔(dān)?為什么?

責(zé)任應(yīng)當(dāng)由出租人承擔(dān)。(1分)根據(jù)規(guī)定,出租人應(yīng)當(dāng)按照約定將租賃物交付承租人,并在租賃期間保持租賃物符合約定的用途。根據(jù)規(guī)定,出租人應(yīng)當(dāng)履行租賃物的維修義務(wù),但當(dāng)事人另有約定的除外。(1分)

According to law, the lessor shall deliver the lease item to the lessee in accordance with the contract and shall, during the lease term, keep the lease item fit for the agreed purpose. And the lessor shall perform the obligations of maintenance and repair of the lease item, except otherwise agreed by the parties. (1分)
<5> 、出租人將房屋出售,是否需要承租人的同意?為什么?
【正確答案】
不需要經(jīng)承租人的同意。(1分)但應(yīng)當(dāng)提前通知承租人。根據(jù)規(guī)定,出租人出賣租賃房屋的,應(yīng)當(dāng)在出賣之前的合理期限內(nèi)通知承租人,承租人享有以同等條件優(yōu)先購買的權(quán)利。 (2分)
It shall not get the consent of the lessee, but a timely notice to the lessee is necessary. According to law,where the lessor is to sell a dwelling unit under a lease, it shall give the lessee a notice within a reasonable time limit before the sale, and the lessee has the right of first refusal under the same conditions.(1分)
